By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this website’s particular services, you shall be subject to any posted guidelines or rules applicable to such services.

Description of Service

TrekWeather provides weather forecasting and information services specifically designed for outdoor enthusiasts, hikers, and trail users. Our services include:

• Weather forecasts and current conditions for trails and outdoor locations

• Interactive weather maps and visualizations

• Location search and favorites functionality

• User accounts for personalized experiences

• Weather alerts and notifications

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization.

Premium Subscriptions

TrekWeather offers optional paid subscription plans (“Premium”) that provide access to additional features. By subscribing to a Premium plan, you agree to the following terms:

Subscription Plans and Pricing

• Monthly Plan: $2.99 per month, billed monthly

• Annual Plan: $29.00 per year, billed annually

Billing and Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You authorize us to charge your payment method on file for the applicable subscription fee at the start of each billing period. Billing is handled securely through Stripe.

Cancellation Policy

You may cancel your subscription at any time by emailing bret@trekweather.com. Upon cancellation, your Premium access will continue until the end of your current billing period. After that, your account will revert to a free account.

Refund Policy

Subscription fees are non-refundable. No refunds or credits will be provided for partial billing periods or unused time. If you believe you were charged in error, please contact us at bret@trekweather.com.

Price Changes

We reserve the right to modify subscription pricing at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing period. Your continued use of Premium features after a price change constitutes acceptance of the new pricing.

Acceptable Use

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts

• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances

• To infringe upon or violate our intellectual property rights or the intellectual property rights of others

• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate

• To submit false or misleading information

• To upload or transmit viruses or any other type of malicious code

• To spam, phish, pharm, pretext, spider, crawl, or scrape

Weather Data Disclaimer

Weather information provided by TrekWeather is for general informational purposes only. While we strive to provide accurate and up-to-date weather data, we cannot guarantee the accuracy, completeness, or timeliness of the information.

IMPORTANT: Weather conditions can change rapidly and unexpectedly. Always check current conditions and forecasts from multiple sources before engaging in outdoor activities. TrekWeather is not responsible for any decisions made based on our weather information.

Users assume all risks associated with outdoor activities and should use proper judgment, preparation, and safety measures regardless of weather forecasts. It is the user’s responsibility to ensure they are adequately prepared for any outdoor activity, regardless of the forecast.

Third-Party Services

Some functionality may rely on third-party services such as authentication providers, analytics platforms, mapping services, and search providers. TrekWeather is not responsible for interruptions, errors, or data handling practices caused by those third-party services.

Your use of third-party services through our platform is subject to their respective terms of service and privacy policies.

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of TrekWeather and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account. Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, TrekWeather:

• Excludes all representations and warranties relating to this website and its contents

• Excludes all liability for damages arising out of or in connection with your use of this website

Limitation of Liability

In no event shall TrekWeather, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Governing Law

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
